At CMS, as Work Opportunity Tax Credit (WOTC) experts and service providers since 1997, we receive a lot of questions via our website’s chat box that we try to answer:

If someone checks off that they have a conditional certification for the work opportunity tax credit, how do I know what target group they are in?

CMS Says: “Check here if you received a conditional certification from the state workforce agency (SWA) or a participating local agency for the work opportunity credit” is the first question on the IRS form 8850 Pre-Screening Notice and Certification Request for the Work Opportunity Credit.

This is an eligibility question. If someone does check Yes to that question a State Workforce Agency has already screened them for eligibility and made a determination that a job-ready applicant is, TENTATIVELY ELIGIBLE as a member of a target group under WOTC. The employee may provide you with the Department of Labor ETA Form 9062, to show that eligibility pre-determination was made for the individual.

The Conditional Certification 9062 form serves as an official record of the pre-certification, alerts prospective employers to the availability of the tax credit if this individual is hired, and provides a means for employers to request a WOTC certification for this person.
