WOTC Questions: I am in HR is it up to the new employee to mention they are part of a targeted group, or is it my duty as HR to ask them such? 

At CMS, as Work Opportunity Tax Credit (WOTC) experts and service providers since 1997, we receive a lot of questions via our website’s chat box that we try to answer:

 I had a question regarding the hiring process when it comes to WOTC.  I am in HR  is it up to the new employee to mention they are part of a targeted group, or is it my duty as HR to ask them such?

CMS Says: It is your duty/part of the companies hiring/onboarding process by using the WOTC questionnaire or forms 8850 and 9061. The employee is very unlikely to know they are a member of a target group for WOTC unless they have been informed by an agency.
