WOTC Questions: If we hire temporary employees for 90 days can we claim the WOTC on those 90 days or not until after we directly hire them?

At CMS, as Work Opportunity Tax Credit (WOTC) experts and service providers since 1997, we receive a lot of questions via our website’s chat box that we try to answer:

If we hire temporary employees for 90 days can we claim the WOTC on those 90 days or not until after we directly hire them?

CMS Says: Hi, hiring temporary employees for 90 days (probationary period?) is fine. They just have to meet that magic 120 hour mark. Even most part-time employees should reach that target within 90 days:

Weekly Hours Hourly Wage Example Weekly Wages Weeks to 120 Hours Weeks to 400 Hours Weeks to $6,000 in Wages
10 $15 150 12 40 40
15 $15 225 8 26.6 26.5
20 $15 300 6 20 20
